In a lawsuit instituted by the Hungarian Helsinki Committee as plaintiff against the Cabinet Office of the Prime Minister as defendant due to the infringement of personality rights, the Curia obligated the Cabinet Office of the Prime Minister to publish the following provisions of the final and absolute judgement adopted in the case:
“The defendant defamed the plaintiff by virtue of the following: In question 5 of the questionnaire entitled “National Consultation About the Soros Plan”, in relation to the actual fact that, in respect of the amendment of the Penal Code in connection with the prohibited crossing of the border fence, the plaintiff argued, with reference to the practice of the Court of Justice of the European Union, that the application of grave legal consequences in relation to unlawful entry gives rise to concern, the defendant created the false impression that the plaintiff sought to achieve that migrants should be handed down milder punishment for the crimes they commit.
The defendant also defamed the plaintiff by the virtue of the following: In relation to the actual fact that the plaintiff also takes action to protect the rights of asylum-seekers and refugees, the defendant created the false impression that the plaintiff defends persons who commit illegal acts.”
